Family Law
With increased awareness combined with complex life styles, the necessity and importance of various domestic contracts such as pre- nuptial agreements, cohabitation agreements, marriage contracts and separation agreements cannot be under estimated.
The Canadian family laws are ever so changing and progressing, designed to deal with and keep pace with the complex life styles and increasing rate of separation and divorce affecting not only the rights and entitlements of partners but the children as well.
Whether you are the unwary spouse or have taken the courage to get out of a difficult relationship, you need reliable legal advice from experienced and caring family law practitioners.
Armed with a properly drafted domestic contract, most of the issues of separation or divorce will be tackled amicably, by the terms of the contract, without lengthy and costly litigation procedures.
In the absence of proper legal advise and properly drafted domestic contract to tackle issues like the custody and access of children, support, division of property, availability of necessary cash flow and the like, the spouse may be faced with unexplainable hardships.
It may also result in the sale of matrimonial home resulting in poor living conditions, loss of old neighborhood and friends for both you and your children and may also mean change of school for them.
With right legal advise, at the right time you will be more equipped to deal with and sail thru these difficult situations. Like many other satisfied clients, you can also trust us to resolve your family law problems.
We provide the following services:
- Divorce, contested or uncontested
- Pre-nuptial agreements, cohabitation agreements & separation agreements
- Custody & Access
- Child Support and Special Expenses
- Spousal Support
- Restraining & Preservation orders
- Division of Property including the matrimonial home, RRSPs, pensions, stocks
- Independent Legal Advice on Agreements & Releases
Wills
Probably you always wanted to make a will, but never got time to make one.
The reason This will not happen to me soon.
"Don't wait for spring, do it now!"
Irrespective of the value of your assets, you have the right to decide who will manage your estate after your death, and how your assets will be distributed.
Armed with a properly drafted will, the division of you assets can be made in a planned manner according to your wish, in a tax effective manner, combined with the fact that there will be a trustee or an executor chosen by you, who will have the right to deal with the assets in your estate immediately upon death.
Remember that there are significant tax consequences at the time of death due to deemed disposition of assets.
Create your own plans while you can.
A properly drafted Will allows you to design how your assets can be distributed in a manner which is ideal for you. In particular, you can provide for the welfare of your family and ensure the efficient management of your property by a trusted person, designated by you.
An ideal estate plan may include two other types of documents: continuing powers of attorney for property, in which you can name the person(s) to handle your financial matters in case of your incapacity; and a personal care powers of attorney for health care, in which you similarly name the person(s) to make medical decisions on your behalf.
